TERMS OF USE FOR APPY PROD SERVICES

1. Rights and Obligations upon using Appy Prod Services – Acceptance of Terms.
These terms and conditions govern the use of Appy Prod Services with its associated functionality, hereinafter referred to as the “Terms”. If you use Appy Prod Services, it is considered an agreement between you and Appy Prod Lilleheier (“Appy Prod Lilleheier ,” “we,” or “us”) and that you have accepted the Terms. If you intend to create or otherwise administer groups within Appy Prod Services, we kindly ask that you pay particular attention to section 2 below.

2. Specifically for Group Administrators
A group administrator is the person who creates a group within Appy Prod Services or has otherwise been authorized to be an administrator for a group. You must be 15 years of age or older to be a group administrator. Being a group administrator entails a certain responsibility and some additional obligations which are set out in our Additional Terms for Administrators. The Additional Terms for Administrators apply together with and form part of these Terms.

3. Age Limit
Although the age limit for being a group administrator is 15 years, Appy Prod Services may be used by children under 15 years of age who are registered as users by the group administrator or the child's guardian. Parts of the service may be subject to other age limits.
4. Changes to the Terms or the Service.
We may change the Terms. In the event of material changes, we will notify you in an appropriate manner. For other changes, new terms will be published on appyprod.com. If you then continue to use Appy Prod Services, you are deemed to have accepted the new terms. We are continuously developing Appy Prod Services. This means that we may add, change, or remove functionality or parts of the service. In the event of major changes, you will be notified in an appropriate manner.

5. Your Use of Appy Prod Services.
If you use Appy Prod Services, you accept that all such use shall be in accordance with these Terms and that you shall otherwise only use the service in accordance with the purpose and intention behind the service. This means, for example, that you shall not:

Use Appy Prod Services in connection with illegal activity, other activity that is generally considered undesirable, or in a manner that may negatively affect Appy Prod Services. In case of doubt or disagreement, we decide whether an activity or use is undesirable or otherwise negative for Appy Prod Services.

Publish content or other material that is, or may be perceived as, inappropriate, indecent, offensive, or derogatory.

Publish content or other material to which someone else holds rights, without an agreement with the right holder(s).

Copy, publish, resell, sublicense, modify, interfere with, gain unauthorized access (or attempt any of the foregoing) to Appy Prod Services, its software, user interface, or other content within Appy Prod Services.

Gain access to, copy, publish, or otherwise use personal data about other users of Appy Prod Services for any purpose other than creating, administering, and participating in Appy Prod groups and events.

Publish information about others to a greater extent than is strictly necessary, and in any case not if there is reason to believe that the individuals concerned may find the information problematic or uncomfortable to be published.

Add participants to Appy Prod groups or events without such participants having first consented to it.

Attempt to circumvent security-related features in Appy Prod Services.

Share your password with others.

6. Appy Prod reserves the right to suspend or close your user account or group access upon reasonable suspicion that your conduct outside of Appy Prod Services is not compatible with your continued use of the service or participation in groups. Examples of such conduct include, but are not limited to:

Breaches of applicable laws and regulations, such as grooming, violence, or other criminal activity.

Actions that may damage Appy Prod's reputation.

7. If you use Appy Prod Services in violation of these principles or the Terms otherwise, we may suspend or close your user account and terminate the agreement with immediate effect. We may, on our own initiative, investigate specific or randomly selected content to detect breaches of the Terms. We may also remove or censor content or other material that we believe violates these Terms, or the purpose or intention of Appy Prod Services.

8. Third-Party Services
Certain services available through Appy Prod Services (for example, weather services) are provided by suppliers other than us. The use of such services may be subject to separate terms and conditions set by such third-party suppliers. We may choose to replace or discontinue third-party services as we wish. We are not responsible for third-party services, such as for the consequences of errors, inaccuracies, or unavailability of the services. When you create a payout account within Appy Prod Services, you must also approve the terms of our payment service provider, currently Stripe. The terms can be found here: https://stripe.com/en-no/legal/connect-account. By using Appy Prod Services, you agree that you are solely responsible for any disputes, chargebacks, or claims arising from transactions processed through your account. It is your responsibility to resolve disputes with your customers and users and ensure compliance with applicable laws and regulations. You authorize Stripe to debit funds related to disputes, chargebacks, claims, etc., directly from the balance in your payout account or the external bank account linked to your Stripe account (your “linked bank account”), as further described in Stripe's agreements. This authorization includes the right to initiate debits for the full amount of the negative balance, as well as any associated fees or costs. You are responsible for ensuring that the balance of your linked bank account remains positive. If the balance becomes negative, for example due to refunds, chargebacks, or fees, you are obliged to cover the deficit. In case of a negative balance, you will be notified of the deficit and the corresponding debit from your linked bank account. If we are unable to retrieve the negative balance through your linked bank account, we reserve the right to take further action, such as suspending your account, initiating collection processes, or pursuing other legal remedies.

9. Disruptions and Errors
Appy Prod Services may from time to time be wholly or partially unavailable due to maintenance, updates, or for other reasons. We will, to the extent practically possible and in such a manner as we deem appropriate, provide information about limitations in availability. In case of errors in Appy Prod Services or in associated services, we will start remediation as quickly as we can after becoming aware of the error. Errors without material significance to the functionality may be rectified in connection with planned upgrades and the like. There is no charge for using Appy Prod Services. For this and other reasons, no compensation can be claimed if you should incur a financial loss in connection with disruptions or errors, but you may choose to terminate the agreement, see section 9. Neither this provision nor other provisions in these Terms are intended to restrict any rights you may have under mandatory consumer legislation.
10. Content and Copyright
Appy Prod Lilleheier is the owner of Appy Prod Services, and holds all copyright, trademark, and other intellectual property rights to the service and content created by or for Appy Prod Lilleheier. You retain all ownership rights to your content. This also means that content or other material published by other users is their property. You cannot use such content unless you have an agreement with the owner of the content. As a user, you are responsible for the content that you publish through Appy Prod Services. Content that violates the rights of a third party will be removed from Appy Prod Services as quickly as possible after we become aware of such content.
11. Termination of the Contractual Relationship
The agreement between you and Appy Prod AS is valid until terminated by either you or Appy Prod AS. You can terminate the agreement by stopping using Appy Prod Services and deleting your user profile. If we wish to terminate the agreement, we will, to the extent possible, notify you in advance.
12. Personal Data
The processing of personal data in connection with Appy Prod Services is regulated in our Privacy Policy.

Disputes The agreement between you and Appy Prod Lilleheier is governed by Norwegian law and any disputes that are not resolved amicably shall be settled by Oslo District Court (Oslo tingrett).
